Terms of sale

These general terms and conditions of sale ("GTCS") apply, without restriction or reservation, to all distance sales made by Monthi Paris 01 SAS, registered with the RCS of Paris Métropole under number 984 249 177, whose registered office is located at 182 rue du Faubourg Saint-Honoré, 75008 PARIS ("Angiolo") to any buyer (the "Customer") wishing to purchase the products offered for sale (the "Products") by Angiolo on the Internet and mobile sites www.angiolo.com (the "Web Site").

These Terms and Conditions of Sale apply to the exclusion of all other terms and conditions, including those applicable to sales in shops or through other distribution and marketing channels.
It is expressly forbidden to purchase Products on the Website in order to resell them to anyone else.
The GTC are available at any time on the Website or on request from the e-mail address contact@angiolo.com. As the GTC may be subject to subsequent amendments, the version applicable to the Customer's purchase is that in force on the Internet Site on the date the order is placed. They shall prevail over any other version or any other contradictory document. Angiolo therefore urges Customers to carefully reread the current Terms and Conditions of Sale each time they place a new order.

Any validation of an order by the Customer implies full and complete acceptance of these Terms and Conditions of Sale and of the specific terms and conditions of the order (products, quantities, prices, delivery method and delivery times, etc.). The Customer declares that he/she has read them and accepted them by ticking the appropriate box before validating the order. The GCS are enforceable against the Customer in accordance with the provisions of article 1119 of the French Civil Code.

ARTICLE 2: Purpose

The purpose of these Terms and Conditions of Sale is to define the Customer's rights and obligations with respect to the online sale of Products offered by Angiolo via the Web Site. In particular, they specify the conditions for ordering, payment, delivery and management of any refunds for Products ordered by the Customer on the Web Site.

ARTICLE 3: Products

Product Information
Angiolo takes special care in presenting each Product on the Web Site. The Products are therefore described and presented as accurately as possible. The description is intended to present to the Customer the essential characteristics of the Products before the order is placed.

To this end, Angiolo provides the Customer with the following information
- The name of the Products,
- Quantity
- Price,
- Means of payment accepted by Angiolo,
- Any delivery restrictions
- The information required by current legislation depending on the nature of the Products (pre-packaged or non-pre-packaged Products), thus enabling the Customer to know the essential characteristics of the Products. Angiolo indicates the use-by date on the packaging of the Products or on a leaflet provided with the Product, it being specified that ice creams collected through Click & Collect are not pre-packaged; the information on the use-by date is therefore confirmed when the Purchaser collects the ice cream from the shop.

The photographs of the Products are not contractual and are intended to illustrate the Products for information purposes only.

Product Quality
Angiolo pays particular attention to the quality of the Products offered for sale on the Web Site. The Products are stored in optimal preservation conditions and are prepared and packaged according to strict quality rules.

Allergy warning
The food Products sold on the Website contain certain allergens, which are specified for each Product on the product sheet page. The Customer may also contact Customer Services for further information at the following address: contact@angiolo.com

Product Availability
Angiolo reserves the right to modify its product line at any time. Certain offers may have a limited validity period, which will be indicated for each product or product line. Angiolo undertakes to honour orders received on the Web Site only within the limits of available stocks. In exceptional cases, a product advertised as available on the Web site may be unavailable after the order has been finalized. In the event that a product is unavailable, Angiolo will inform the Customer that the unavailable product has been cancelled:

- by e-mail in the case of home delivery ;
- by telephone in the case of in-store pick-ups or by e-mail if Customer Service does not receive a response from the Customer by telephone.
The product will be refunded within thirty (30) days.

To place an order, the Customer has two options:

All information provided by the Customer is his/her sole responsibility and Angiolo cannot be held liable for any anomalies generated by the Customer in the event that it becomes impossible to proceed with the order or to ensure a positive result.

The Client must choose a username and password to access his/her account, which he/she must not disclose to anyone. Angiolo will not be liable for any loss or damage that may occur as a result of failing to protect the Customer's ID or password. If the Customer forgets his/her password, an appropriate function on the Web Site allows the Customer to retrieve it using his/her e-mail address.

- Or to enter their personal details to receive their parcel (surname, first name, telephone number, e-mail and postal address) without opening a Customer account. In this case, the data provided by the Customer at the time of purchase (last name, first name, telephone number, e-mail and postal address) may be retained by Angiolo for a period of three years from the end of the business relationship.

Before confirming payment for the order, it is the Customer's responsibility to check the accuracy of the order and the information given and to make any changes.

Validation of the order by the Customer implies acceptance of these GCS in their entirety. As soon as the Customer confirms the order, it is automatically recorded. Angiolo will not consider any request for modification or cancellation.

Order Confirmation
Angiolo will confirm receipt of the order by e-mail to the address provided by the Customer, with a summary of (i) the Products ordered, (ii) the address, (iii) the delivery method, (iv) the method of payment, and (v) the Customer's order number.

Any order placed by the Customer will only be definitive once the Customer has received confirmation of the order and once the bank has recorded the full price of the order, including delivery costs. The distance selling contract between the Customer and Angiolo is formed when Angiolo confirms the order.

Angiolo reserves the right to cancel or refuse any order from a Customer with whom there is a dispute over payment of a previous order or who presents any form of risk to Angiolo.

Changing an Order
Angiolo invites the Customer to contact Customer Service:

Proof of order
Confirmation of the order by Angiolo, the data recorded by Angiolo using the automatic recording systems on the Web Site or by its remote sales service, and any e-mail exchanged between Angiolo and the Customer will be considered as proof of the nature, content and date of the transaction in the event of a dispute between the Parties and will be kept by Angiolo for the length of time required to comply with legal statutes of limitation.

ARTICLE 5: Price and Payment Terms
Prices
The Products are supplied at the prices in effect on the Web Site at the time the Customer places the order. Prices are expressed in euros, exclusive of tax and, where applicable, inclusive of all taxes according to the VAT rate in force on the day the order is registered, and exclusive of shipping costs. The costs of processing, shipping, transport and delivery will be invoiced in addition under the conditions indicated on the Website and calculated prior to validation of the order. Any additional costs added to the price of the Product(s) ordered must be expressly agreed by the Customer. The final price charged to the Customer corresponds to the total amount of the purchase, including these charges. The total price, including taxes, indicated in the order confirmation sent by Angiolo is the total price of the order, including taxes, the price of the Products and any additional costs, such as shipping costs.

The prices displayed on the Web Site may be revised at any time without notice based on the price of seasonal products and economic conditions.

Any validation of an order implies acceptance of the price.
An invoice is issued when Angiolo ships the order and is available in the customer account under "My Account > My Orders > Order Details > View Invoice".

Agreement on proof
Confirmation of the order, payment for the order and confirmation of the order by e-mail constitute proof of the completeness of the order and render payable the sums owed by the Customer to Angiolo for the order.

Payment (Secure Transactions)
The Customer acknowledges that placing an order necessarily implies payment in cash at the time of ordering by credit card or Paypal.

The following bank cards are accepted for online payment: Carte Bleue, Visa, MasterCard and American Express. Depending on the type of card, the Customer enters the card number, expiry date and cryptogram code (consisting of three or four digits, depending on the card, located on the back of the bank card) and then validates the data or has the option of returning to the previous page.

The payment request is sent in real time to the Ingenico SA secure payment system, which checks that the bank card is valid (no input errors, no stop payments) and confirms that the payment has been recorded by issuing a transaction number or informs the customer that the transaction has been refused. The final validation step consists of the Client receiving a validation code to definitively validate the payment.

The Customer warrants to Angiolo that he/she has the necessary authorizations to use the payment method. The billing information that the Customer declares at the time of the order must correspond to that of the holder of the payment card used, in order to allow Angiolo to contact the latter directly if necessary, in particular for verification purposes or to request additional information. The Customer must pay close attention to the information provided regarding his/her credit card and delivery address.

Angiolo reserves the right not to confirm orders in the event of non-payment, incorrect billing address, or any other problem caused by the Customer in connection with the payment of the order.

Angiolo also reserves the right to cancel or refuse any order that is abnormal, placed in bad faith or for any other legitimate reason, including an order from a Customer with whom there is a dispute over payment of a previous order.

Once an order has been paid for, it becomes definitive and can no longer be cancelled by the Customer. A summary of the order is displayed and an e-mail confirming the order is sent to the Customer.

The bank checks that the bank card is valid (no input errors, no opposition), and confirms that the payment has been registered or informs the Customer that the transaction has been refused.

Angiolo cannot be held liable in the event of fraudulent use. In the absence of bank funds, or in the event of a bank refusal, the order will be automatically cancelled and the Customer will be notified by e-mail.

ARTICLE 6: Delivery
Conditions
The Products can only be dispatched once the transaction has been validated.

Any event defined by the Civil Code and case law as a case of force majeure likely to delay or prevent the supply or increase the cost of the products ordered constitutes a cause for suspension or termination of the obligations incumbent on Angiolo if the event in question exceeds a period of fifteen (15) days, without compensation for the Customer. Angiolo undertakes to inform the Customer by any appropriate means in the event of the occurrence of such an event of force majeure, who is authorized to cancel his/her order by e-mail.

The Products ordered will be delivered to Paris and its suburbs. Delivery is made according to the times indicated for each delivery method and to the address given by the Customer when placing the order on the Website. Delivery consists of the transfer to the Customer of physical possession of the Product ordered. Except in special cases, the Products ordered are delivered all at once.

Delivery times
Delivery times are indicated to the Customer on the date the order is placed.

The Customer may choose the delivery date when placing the order. The delivery timetable proposed to the Customer offers possibilities of up to 10 working days.

Delivery times are given for information purposes only and Angiolo undertakes to make every effort to meet them.

The delivery dates and times indicated are subject to correct and punctual delivery of the goods by Angiolo's suppliers and by the delivery service providers appointed by Angiolo. However, Angiolo cannot be held responsible for late deliveries caused by its carriers.

Consequently, no refund will be granted to a Customer who refuses a delivery on the grounds that it is not made on the chosen day.

If the Products ordered are not delivered within thirty (30) working days of confirmation of the order, for any reason other than force majeure as described in article 6 hereof or the fault of the Customer, the sale may be cancelled at the Customer's request under the conditions set out in articles L. 216-2 and L. 216-3 of the French Consumer Code. The sums paid by the Customer will be returned to him at the latest within fourteen (14) days following the date of cancellation of the contract, to the exclusion of any compensation or deduction.

Focus on public holidays :

Public holidays are to be understood as the public holidays in which the delivery and dispatch addresses of the order are located.
It should be noted that any order placed the day before a public holiday will be prepared and dispatched on the next working day. If the Customer chooses the first available date proposed on the Website (for example, if the Customer orders on 24 December, the order will only be prepared and dispatched on 26 December). Similarly, any order placed on a public holiday will be prepared and dispatched on the next working day following the said public holiday.

Focus on Customer details :

As a reminder, the Customer is responsible for the information provided concerning the name and address of the recipient. This information must be precise, accurate and complete (particularly with regard to the entrance door code and the floor) so that the delivery can take place under the best possible conditions. Under no circumstances will Angiolo be held responsible for a return delivery due to an error in the delivery address or to the impossibility of delivering to the address indicated. Costs related to a change in the recipient's delivery address will be billed to the Customer. If the recipient is absent on the day of delivery, the delivery person will leave a calling card, a text message or an e-mail at the delivery address.

It should be noted that for all home delivery orders, the Customer must provide the recipient's local telephone number (ideally a mobile phone local to the country of delivery). The service provider appointed by Angiolo will not contact numbers outside the country of delivery.

Focus on Customer reservations:

It is the Customer's responsibility to check the contents of the order on the date of delivery. Any discrepancies in quantity must be reported to Angiolo within 24 hours of receiving the order, in accordance with the conditions set forth in Article 7 herein. Complaints regarding damage, delay, loss or inadequate packaging must be communicated in writing within three days of receipt of the order under the conditions listed in Article 7 hereof.

In addition, if the shipping company appointed by Angiolo is unable to contact the Customer, the Customer will not be entitled to reimbursement of shipping costs.

Given the perishable nature of the products offered by Angiolo, in the event of a return package, Angiolo will systematically destroy the food products and the Customer will not be entitled to a refund or replacement.

If you have any questions about your Click & Collect order and its collection, you can contact the shop where you placed your order directly.

ARTICLE 7: Receipt
The Products are received when the Customer takes physical possession of them (the "Receipt"). The Customer must check the condition of the Products as soon as they are received. In case of shortage, loss or damage, the Customer must make all reservations:

Angiolo will reimburse shipping costs on the basis of the invoiced rate and will reimburse return shipping costs in the event of a claim (excluding exercise of the right of withdrawal) upon presentation of supporting documents.

After analyzing the situation, Angiolo will, at its discretion, determine the appropriate arrangement, refund of the sums paid or redelivery of the Products within thirty (30) days of the cancellation of the order. By accepting such replacement or refund, the Customer or any other party concerned agrees to waive any additional claims that may be made, including in particular the payment of interest.

ANGIOLO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES INCLUDING, WITHOUT LIMITATION, LOSS OF PROFITS, REVENUES OR BENEFITS ARISING OUT OF OR IN CONNECTION WITH ANY BREACH OF THESE TERMS AND CONDITIONS OF SALE OR ANY CLAIM MADE AGAINST YOU BY ANY THIRD PARTY.
